The Los Angeles Times reports that the US Court of Appeal has upheld its earlier ruling to invalidate a US$500,000 Federal Communications Commission (FCC) indecency fine imposed on television network CBS for Janet Jackson's 2004 on-air "wardrobe malfunction". During a Super Bowl halftime show, Justin Timberlake reportedly tore off a piece of Ms Jackson's costume and exposed her breast to an audience of over 90 million viewers for a few seconds. The court reportedly found that the FCC's enforcement of the fine represented an undisclosed change to its "fleeting images" policy, and was therefore improperly imposed.
