Settlement Finalised in Privacy Case

The US Federal Trade Commission (FTC) has announced that the proposed settlement with US Search has been finalised, with the release of a Decision and Order (14 March 2011). The FTC took action against US Search alleging that the company had made deceptive representations to consumers regarding personal data privacy. US Search had falsely promised to secure consumers’ records in return for a US$10 fee. As part of the settlement, the company must refund such fees to nearly 5,000 consumers and must not make further “misrepresentations about the effectiveness of any service that claims to remove information about consumers from the broker’s website”.
